Welcome to the mybiOSis ecosystem, including the mybiOSis websites (mybiosis.info, kladia.info, trillia.info or the “Website”), the Nature Digital Object Repository (NDOR), kladOS web applications, and associated mobile applications such as LitterMapper, MacrophyteMapper, WaterBodyStructureMapper and NatRec.

The mybiOSis ecosystem includes websites, databases, web applications and mobile applications that may be distributed through platforms such as Google Play or the Apple App Store.

Specific websites, services and applications may be developed, operated or distributed by different ecosystem partners, including MYNATURE Association, BIODIV.SYSTEMS S.R.L., KLADIA.STUDIO S.R.L. and other project partners, depending on the project, service or application.

These websites, databases, web applications and mobile applications are offered subject to your acceptance of these Terms and Conditions, including the mybiOSis Privacy Policy.

Acceptance of these terms

Please read this Agreement carefully before accessing or using the Website, web applications, databases or mobile applications.

By accessing or using any part of the Website, each user (“you” or “members”) agrees to the terms and conditions of this Agreement.

If you do not agree to all the terms and conditions of this Agreement, you should not access the Website or use any services made available through the mybiOSis ecosystem, including services hosted through kladia.info, trillia.info or associated mobile applications.

Your mybiOSis account

If you create an account on the Website or mobile applications, you are responsible for maintaining the security of your account. You are fully responsible for all activities that occur under the account and for any other actions taken in connection with the account.

mybiOSis Project administrators may, at their discretion, remove content that is considered inappropriate or unlawful.

The mybiOSis Project and ecosystem partners will not be liable for acts performed by you, including any damages of any kind incurred as a result of such acts.

Please make sure that your username is not misleading, does not make readers think that you are another person or company, and does not contain inappropriate words.

Contribution rules

If you post content to the Website, NDOR, kladOS or associated mobile applications, or allow any third party to do so, you are entirely responsible for the content and for any harm resulting from that content. This applies regardless of the type of content, including text, images, graphics, audio files or other material.

When posting or uploading content to the Website, NDOR or related services, the following rules apply:

• You agree that you are participating and submitting content in good faith.
• You own and control the rights to the content you post, or you otherwise have the right to post such content.
• The content is accurate and not misleading.
• The content will not violate the rights of, or cause injury to, any person or entity.
• The content does not contain or install viruses, malware, Trojan horses or other harmful or destructive material.
• The content is not spam and does not contain unethical or unwanted commercial content.
• You will post only content that is relevant to mybiOSis.
• You will not post content at a rate or volume that hinders other users’ ability to use mybiOSis.
• You will not post redundant content. Series of redundant digital objects, such as images, graphics or audio files, are not usually accepted and may be removed at the discretion of mybiOSis Project administrators.
• The content is not defamatory.
• The content does not contain political propaganda, threats or incitement to violence toward individuals or entities.
• The content does not violate the privacy or publicity rights of any third party.
• Your content is not advertised through unwanted electronic messages, spam links, email lists, newsgroups, journals, websites or similar unsolicited promotional methods.

Rights granted for submitted content

By submitting content to the mybiOSis Project for inclusion on the Website, NDOR, kladOS or associated mobile applications, you grant mybiOSis a worldwide, royalty-free and non-exclusive license to reproduce, modify, adapt and publish the content solely for the purpose of displaying, distributing and promoting your observations through the mybiOSis Website or associated mobile applications.

We may also use the content for other purposes not subject to known legal restrictions, such as training machine learning software or artificial intelligence tools.

Your content will always remain yours, and you can delete it at any time where deletion tools are available. If you delete content, mybiOSis will use reasonable efforts to remove it from the Website. However, you acknowledge that caching or some references to the content may not immediately become unavailable.

Backup copies may remain in our databases for some time, but they will not normally be accessible to the public.

Visibility of contributed content

Any content you contribute to the Website, NDOR, kladOS or related mobile applications may be available to users of the Website or related applications.

Within the Website or mobile applications, you may find tools for restricting or expanding visibility, or for setting ownership and access options for your content.

If you are not comfortable with this, you should not use the service.

Think carefully before posting information that could identify you personally, including your full name, home address, telephone number, email address or school. If you are under age, do not post this information to the site.

Responsibility for posted material

mybiOSis administrators have not reviewed, and cannot review, all material posted to the Website, including computer software. They therefore cannot be responsible for that material’s content, use or effects.

You agree not to threaten, abuse, solicit, spam, harass, impersonate or intimidate other Website members.

You also agree not to collect or store location data or other personal information about other Website members obtained from the Website, unless you have permission to do so.

By operating the Website, mybiOSis does not represent or imply that it endorses material posted to the Website, or that it believes such material to be accurate, useful, non-infringing or non-harmful.

You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses and other harmful or destructive content.

Copyright infringement

The mybiOSis Project respects the intellectual property rights of others and asks members of the mybiOSis Website, services and mobile applications to do the same.

If you believe that your work has been copied on the Website in a way that constitutes copyright infringement, please provide mybiOSis administrators with specific information about the content and the nature of the concern.

It is the mybiOSis Project’s policy to respond to notifications of copyright infringement.

Intellectual property

All trademarks, graphics and logos used in connection with the mybiOSis Project or the Website are trademarks or registered trademarks of MYNATURE Association, ecosystem partners or other third parties.

Your use of the Website grants you no right or license to reproduce or otherwise use any MYNATURE Association, mybiOSis or third-party trademarks.

This Agreement does not transfer to you any mybiOSis Project, MYNATURE Association, ecosystem partner or third-party intellectual property. All right, title and interest in such property will remain solely with the relevant mybiOSis Project, MYNATURE Association, ecosystem partner or third-party owner.

No commercial or unauthorized use

You agree not to use the Website, the mybiOSis Project, NDOR or any mybiOSis content for commercial purposes, or for any illegal, unlawful, inappropriate or unauthorized purpose or activity, unless explicitly permitted.

Termination

The mybiOSis Project may terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately.

If you wish to terminate this Agreement or your mybiOSis Project account, you may discontinue using the Website and use available account or data deletion options where applicable.

All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Disclaimer of warranties

The Website and associated services are provided “as is.”

The mybiOSis Project, ecosystem partners, suppliers and members disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement.

Neither the mybiOSis Project nor its suppliers or members make any warranty that the Website will be error-free or that access to it will be continuous or uninterrupted.

You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.

Limitation of liability

In no event will the mybiOSis Project, MYNATURE Association or ecosystem partners be liable with respect to any subject matter of this Agreement under any contract, negligence, strict liability or other legal or equitable theory for any special, incidental or consequential damages, the cost of procurement of substitute products or services, interruption of use, or loss or corruption of data.

The mybiOSis Project, MYNATURE Association and ecosystem partners shall have no liability for any failure or delay due to matters beyond their reasonable control.

User warranty

You represent and warrant that:

• Your use of the Website will be in strict accordance with the mybiOSis Privacy Policy, this Agreement, and all applicable laws and regulations.
• Your use of the Website will not infringe or misappropriate the intellectual property rights of any third party.

Changes to these terms

The mybiOSis Project reserves the right to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes.

Your continued use of, or access to, the Website following the posting of any changes to this Agreement constitutes acceptance of those changes.

The mybiOSis Project may in the future offer new services, features, tools or resources through the Website. Such new features and services shall be subject to these Terms and Conditions.
